Definitions:

1.2 "Consumer" has the meaning defined in section 12 of the Unfair Contract Terms Act 1977.

1.3 "Contract" refers to the agreement between Marine World Aquatics and the Buyer for the sale and purchase of goods, including these Terms and Conditions.

1.4 "Goods" are the items that the Buyer agrees to purchase from Marine World Aquatics.

1.5 "Seller" is Marine World Aquatics, the supplier of the Goods.

1.6 "Terms and Conditions" refers to the terms and conditions of sale outlined in this document, including any special terms and conditions agreed upon in writing by Marine World Aquatics.

Conditions:

2.1 The Buyer's statutory rights as a Consumer are not affected by these Terms and Conditions.

2.2 These Terms and Conditions apply to all contracts of sale of Goods from Marine World Aquatics to the Buyer and supersede any other documentation or communication from the Buyer.

2.3 The Buyer's acceptance of delivery of the Goods serves as conclusive evidence of their acceptance of these Terms and Conditions.

2.4 Any variations to these Terms and Conditions, including special terms and conditions agreed upon by both parties, must be agreed upon in writing by Marine World Aquatics to be applicable.

Ordering:

3.1 All orders for Goods are considered an offer by the Buyer to purchase Goods in accordance with these Terms and Conditions. Marine World Aquatics has the discretion to refuse any order for any reason. Please note we try are best to complete orders, but it is subject to current stock levels, while some items show in stock, this is livestock and sometimes when an item was in stock at the time of listing, it may not be in stock at the time of ordering, Due to covid virus effecting deliveries into United Kingdom from suppliers, we are acting on sending 50-100% of orders fulfilled that will be shipped & any outstanding items over 50% of orders completed will be instantly refunded on day of dispatch, so please add reserves to avoid disappointment.
we aim to complete any order within 30 Days due to nature of items.

Price and Payment:

4.1 The price of the Goods is as specified on Marine World Aquatics' current price list and does not include VAT or delivery charges. Additional delivery charges apply for both domestic and international shipments.

4.2 Full payment of the Price and delivery charges must be made before the Goods are dispatched.

Rights of Marine World Aquatics:

Marine World Aquatics reserves the right to adjust the price and specification of any item in its current price list.

Warranty:

Marine World Aquatics warrants that the Goods will correspond to the description given at the time of dispatch. While we strive to ensure that the Goods received by the Buyer closely resemble the photographs shown on the website, please note that variations may occur due to factors such as lighting and living conditions. Any other warranties, conditions, or terms relating to fitness for purpose, merchantability, or the condition of the Goods are excluded, unless the Buyer is dealing as a Consumer and is satisfied with the suitability of the Goods for their intended purpose.

Live Arrival:

We are confident in the health of all the livestock we send, and we offer a Live Arrival Guarantee. To be eligible for our Live Arrival Guarantee, please adhere to the following Dead On Arrival (DOA) procedure correctly:

- In the unlikely event of your order being DOA, please contact us via email or telephone within 1 hour of signing for the package on the day of receipt.

- Provide us with photographic evidence within 4 hours, including a clear photograph of the fish, invert or coral in its original sealed bag, as well as a photograph of it outside the bag with its rear caudal tail fin cut off.

Failure to submit a claim in accordance with the DOA reporting procedure or being unavailable to sign for the parcel on the first delivery attempt will void any claims. Marine World Aquatics may request the return of any DOA items and will cover return postage costs. A credit note will be issued upon satisfactory evidence of the marine life being DOA.

POSTAGE:

At Marine World Aquatics, We take pride in delivering high-quality livestock straight to your doorstep. However it is important to note that we do not cover postage for any potential issues that may occur during transit.

When it comes to delivery of our livestock, We use trusted third party services. While this ensures reliable and efficient shipping, It also means that any DOA (Dead on Arrival) incidents can not be covered by Marine World Aquatics.

Despite this, we are committed to delivering healthy and vibrant aquatic life to our customers. By carefully packing and preparing your order, we strive to minimize any potential risks during transportation.

When purchasing from Marine World Aquatics, it is essential to be aware of the responsibility associated with the transportation process, By Understanding that we do not cover postage for DOA incidents, you can make informed decision before placing order.
